I disagree completely. If and when Sony fails in this case the judging ruling will bring to light the lack of clear jurisdiction or if Sony has violated consumer law in their attempts to revoke product functions promised at point of sale. This will be processed and addressed and it is a necessary first step for clear definitions in the law to be made. Until a bill is created judges will refer to this a guideline for precedence in such matters. This isn't a simple case, and will likely go on for a long, long time. Sony is opening a legal can of worms, and I don't think it is going to like the outcome. If fully except a lot of lobbiest to start bribing the US senate over this issue when it fails in the courts.

Secondly, according the the TRO, the equipment will be impounded by the state, not confiscated by Sony Corporation. Any searching through the computers for evidence must be done with through the proper legal channels or evidence would be considered inadmissible.
Even in civil cases, taking the fifth if your testimony could possibly incriminate you on another charge is still very much valid. If you don't take the fifth, what you say can be used against you in separate criminal charges.
As i understand it, to actually compel you to testify, they must grant you immunity from prosecution based on your testimony.
If there is evidence to be gained if you do not take the fifth, it's still wise. It may not be enough to save you in a civil case, but it's far from useless.

I only said it was useless in the sense that it would screw you over in your civil case. But if you issue is fear over criminal charges and that testimony being used against you in a criminal trial, then yes, taking the fifth is very useful.
