Sifting through the hundreds of pages, I'm still confused on how OFW consoles are being banned. Is this because of PSN accounts being used across CFW/OFW consoles, or is this ban occurring by IP?

To those who are banned; are you still able to trigger console updates via network?

PlayStation(R)3 system have been recently released by
hackers for the PlayStation(R)3 system. These devices
permit the use of unauthorized or pirated software.
Use of such devices or software violates the terms
of your "System Software License Agreement for the
PlayStation(R)3 System" and the "Terms of Services
and User Agreement" for the PlayStation(R)Network/
Qriocity(TM) and its Community Code of Conduct provisions.
In addition, copying or playing pirated software is
a violation of International Copyright Laws.
A circumvention device and/or unauthorized or pirated
software currently resides on your PlayStation(R)3 system.
Immediately cease use and remove all circumvention devices
and delete all unauthorized or pirated software from your
PlayStation(R)3 system. Failure to do so will result in
termination of your access to the PlayStation(R)Network
and access to Qriocity(TM) services through your
PlayStation(R)3 system.

If geohot wins, and jailbreaking the ps3 gets declared legal, there are a few things that can happen.

1) Geohot helps sony to find a piracy free homebrew solution, jailbreaking not needed, so CFW gets prevented anyway. (We can all dream, but Geohot would be more than happy to go for it.)
2) Geohot releases the full signer. All jailbreakers get banned, people who want both homebrew and online get two ps3s. Probably the most likely case.
3) Sony is forced to remove the rootkit scanner, or enjoined from banning people who've only engaged in lawful jailbreaking. 3.56 CFW happens, and only actual pirates and cheaters get banned.

If SOny wins of course homebrew stays on 3.55 forever.

Jailbreaking the PS3 could be determined legal but that doesn't mean that Sony has to let you on the PSN with a jailbroken console.

Hate speech is protected under the first amendment in the US, you can legally call people n**ger or other racial slurs and it's protected free speech, but that certainly doesn't mean that Sony has to let you hold Klan meetings with your bigot-buddies on their network.

The funny this is I'm online right now and just got offline and online again and can connect to PSN without any trouble. Sony is crazy and is making people crazy with them.

"Your PS3 has been found using inappropriate (pirated) software, you have voided the terms for PS3 System Software and PSN; PSN will no longer work for you".
