not true at all. last year in august of 09', microsoft delivered a "mandatory" update that would disable (blowing certain fuses around the nand chip) certain hardware to prevent hacking the jtag on the mainboard (jtag hack). the 08/09 update also updated the kernel version. this update was mandatory and at that time no one (besides microsoft) had any idea about the technicalities.
the example of above sets the perspective clear that a video game console company can manipulate your console without your consent and get away with it.
