Ugh! I hate having stuff censored like that. If some twat wants to post warez on his site then it's his business. There's no reason we can't post the link since it will be his ass on the line, not ours.
unfortunately, you are liable in the USA just for LINKING to warez! unfortunate, but that's the law. ANd because there are moderators here, there's no safe harbor provisions to save you. so unfortunately, there's little choice in the matter. Remember how google censored their links to K-lite?
As for the SNK charcters, how legal that is depends on what SNK/Playmore thinks. On the one hand, since there is no charge for it, they probably won't care that much. But tradmark law is a peculiar thing, and when they discover it, they may have to decide either to grant or deny permission right that instant. That's why studios take such a heavy hand against fan fiction. By apropriating thier trademarks without action taken against them, the trademark protection is weakened. The more enlightened studios have a "don't ask, don't tell" policy about fanfiction. If they are unaware of the violation, then it doesn't affect their rights any, and they can leave it alone. If they become aware, than they must intervene, either to make them take it down, or grant explicit permission for that author.
It's not the same for copyright at all. Selective enforcement is the rule for copyright violation. Ignoring a violation does not only not remove your copyright rights, it doesn't prevent you from changing your mind later! Once permission is actually granted, then it can't be retroactively revoked, but anything else is fair game! ******* is one of the nastiest examples of this. When they see one of *their* images on your website, they wait. and wait.. and wait... until you've racked up statuatory damages that they are certain are in excess of your profit. THEN they sue your ass for everything you've got! Oh, and they will not help you find the offending image in anyway until it's too late. They's rather take all your money than make you remove the infringing file. That is perfectly legal under US law. It's quite despicable, and it totally against the spirit of copyright, but it's legal.
pixel I have a question for you (terribly sorry if it's a stupid one and for my bad english also ): how come beats of rage is also distributed on the french site where you recently became a moderator if it's illegal? ( I don't add the link to the website since it's considered warez here).
Because the owners of metagames-fr are a bit clueless about "legality". They know that they shouldn't offer in download any game that you can find in the local store. But apart of that, they can't think of anything else which could be illegal.
On the same level, they are offering a "PS2 linux distribution". For them, "linux" is free, so, why can't they offer it for download ? What they can't seem to understand is the fact that any linux for PS2 needs a piece of software owned by Sony, which is illegal to copy: the RTE.
The heart of the problem is: people needs to be teached. And most of the time, they only care about "legality" because it can cause them troubles if they do things which are illegal.
On a side note: recently a french magazine called "E-Mulez" was given with a CD containing illegal stuff (including Beats of Rage, and the PSX's scph-1001 bios), and tutorials like "How to 'backup' your games by downloading isos from Internet". The paper is still alive...

Well, I am at fixing some remaining small glitches here and there. There's still some clicks noise from time to time in the sound stream (although it's much better than what it was at the beginning), and the bottom of the screen is sometime not really well updated... must be a weired kindof buffer overflow or something... I'd like to wipe these glitches up before releasing... Or I'll release as it, and hope that somebody will fix it for me :P
