microsoft has been more vigorous that sony in prosecuting modchip sellers; mircosoft australia broaght the action against lik-sang and was joined by sony and nintendo at its behest, although nintendo's current third generation console doesn't even have a modchip!! (yet - but they did sell the gba/n64 stuff). In Australia, Sony is appealling the infamous case against eddy stevens which it looks likely to succeed; they lost previously on the point that the modchip in question was not a circumvention device becuase it 'did not directly prevent the infringement of copyright' - the judge here was influenced by a parliamentary speech of the relevant section (s116A Copyright Act (Cth)) that said prosecution should be limited to ppl selling chips circumventing copy control measures. They look likely to win as s116A addresses both, and the case against Channel Technology in the UK was VERY similar (both the relevant provsions come from a treaty banning modchips - the World Intellectual Property Orgarnagination's Copyright Treaty (WCT) Article 11, Articale 18) As for the US it wouldn't seem to matter if they were flashed or not, the DMCA's circumvention provision (s1201) is broader than the WCT - it would be a little more difficult to rposecute ppl selling unflashed chips, but if they knew or OUGHT TO HAVE KNOWN (ie objective knowledge) that the chips were going to be used to infringe copyright, then they are fried; its simply a case of bringing in the experts and seeing what ppl are using the chips for. Lastly - all these sections apply not only to modchips but also to any cicumvention devices such as DeCSS, and are all very widely drafted, which seems to be the reason copyright holders may win this round.

This really sucks for david, and no doubt will send a shock wave through the scene. I know I will take more precautions in the future.
This makes me question the legality of actually performing mods on systems, if the customer supplies the chip or if a blank chip is used.
Most people here are bringing up our right to do whatever we want with our property, but that isn't really the point at all. I don't think sony or ms care if you break your controller or stick your console up your ass. They care if you play pirated games on your system without paying them the money they feel they deserve (which they probably do). That is the bottom line.
Krazy8 was distributing copy-written/reverse engineered/illegally modified code on chips in the United States via his extremely popular website which was already a huge target. In my opinion he was incredibly ignorant and made it too easy for the people who had it out for him. What company is probably the most affected by software pirates in the world? I'd guess Microsoft. What better way to send a message to the copyright infringing community than to take ownership of essentially the pirates guide that thousands (of pirates) visit daily. "Arrrr Matee"
I'm not saying I feel the penalty fits the crime (btw I believe he made a hell of a lot more money than $28,500 from selling chips), or that I am any less guilty than he is. I am just saying that I am not surprised when people committing crimes in public, all while advertising it, get in trouble. Why are you?
Currently, most of what we do is illegal. If you want to change something... VOTE, write your representative, and inform other people. I admit it isn't as fun talking about prison sex, joking about sticking things up our asses (notice a theme developing... LOL), or playing pirated games, but it is constructive.
Our (US) laws are changing rapidly, and it is very scary. If we don't stop these money/power/oil hungry people in power, someone is going to have to "liberate" us. Look at the PATRIOT act which is about to become permanent. Notice how there are about 6 companies that control almost all of the information we receive (news/entertainment), unless you make a real effort to get outside information. The same companies (along with alcohol, tobacco, oil) that pay for our politicians campaigns, cars, airplaines, houses, etc. The same companies that put David Rocci in jail. Who is really in control of this runaway train?

EDIT: On second look at the laws of the DMCA, I don't believe that the chips need to contain copywritten material to be considered illegal. The DMCA states that any copyright circumvention device/software is illegal. With that said, any mod chip even if the code is written from scratch (like ps2 chips) is probably considered illegal. :confused: :wow: :crazy:
Looks like all the mod companies will have to start planning their blank chips like the titansx (www.selfmod.com). If they don't evolve, they will surely die. More laws like the DMCA are coming to a country near you!

I completely agree with dotkambot. I realized something about this country recently, money is power. M$ and the other big players use their money to control what we can and cannot do. And the judge that sentenced David was probably in the back pocket of these corporations. Unfortunately, that's how capitalism works
I know one thing, I'm glad there's people out there like that with the balls to provide the illegal products and services that I do so much enjoy. :D
