What does the scene need with the internal blu-ray drive? The only device capable of dumping games?
Give full RSX. Give full access to everything BUT the drive.
If you are really good, give limited access to the drive that allows reading media other than retail ps3 games.

The simple fact is "backup managers" are a tool for piracy. Sure, they can be used to install discs you own. They can also be used to install discs you borrow or rent. Sony cannot tell the difference, so they assume the most likely scenario (piracy).
I think most legitimate homebrew developers would be happy with an alternate hypervisor that blocks the drive and updating the firmware, but allows everything else.
If sony puts otheros back, geohot will not help them secure their future firmware (though he will stop hacking). He will only do that if a homebrew enviroment that is good enough to develop a ps3 game in is made.

You think that just because you can run code of your own and get access to the RSX that you can develop an actual game that can be sold retail?
No, you are going to pay for the devkit, get the docs, integrate the needed library functions, and take advantage of their copy protection. And you are going to be able to test the game on the real blu-ray drive that's locked out under the new proposed hypervisor.
Maybe geohot should just use that money to move out of the USA and therefore not have to put up with the awful awful DMCA laws.
Since hes going to lose anyway unless he can get that law changed.
