The upgrading you guys are speaking of are for a very few select titles. This is not for every PS3 game, that is not how that will work. it is basically for a few games that will be on the PS4 launch.
this is the article here you spoke of
Are you feeling ok? Saying the bluray player makes more noise, is a detail. Saying there is a secondary chip that starts the console between 1-4AM to download and install updates, is a detail. Saying power consumption depends on what you are running, eventhough most know that already, is a detail. We are not talking to a clerk, asking for a PC that will run certain programs at a low wattage.... We are looking at new little pieces of information about a games console which isn't released yet. *pats your head* It's ok.

If memory serves me correctly, only the slim based (not superslim) console can use an e3 flasher for dual booting firmware. So I take it, you must have those slimline version of the PS3? Progskeet Team promised the same thing for the Phat NAND model, but they lied about it.
After researching, some of the newer phat models do have nor and not nand. I forgot about those phat version console. I can only assume that your PS3 is nor based console or is it nand?
PS3 PHAT CECHK03 DIA-002
which is nor
Forced updates will only get someones attention to bypass it. Not a nice surprise from Sony at all but expected nonetheless.
The secondary chip for ultra-low power operation will mostly activate at night from 1 to 4 AM and download any required update automatically.
What people need to start doing, Would be epic to do on this generation. If you do not agree with the ToS then return the unit. Think about if a huge number of people did that.. Your never going to get everyone in the market to do that, but if you had a good amount to put a dent in sales. Then that would get the attention sony and then boom ToS and such would be changed, if the dent was large enough. When they do things as they do and people buy their products you going to see them get more intrusive.

Really this is the time for the public to take a stand.
