let me ask you this. do you really think all these video games are worth $59.99 each when they come out? and then a couple months later they are $29.99. how is that fair if you bought it when it first came out and paid more. i say screw SONY and any other other greedy company that tries to take advantage of it's customers. if they want to stop piracy hears an idea make the DAMN games affordable so we could buy all of them. and when we buy the game and get it home and it sux and ain't like the promos we see give us our money back. that aint gonna happen so i say screw em. hack away, pirate away, yo! ho! yo! ho!

This all day long. In the US it is impossible to sign your rights away. This is simply a tactic to convince you otherwise. It's like at the end of a football game when the announcere says:

"Any other use of this telecast or any pictures, descriptions, or accounts of the game without the NFL's consent is prohibited"


Yeah, it's 'prohibited' by the NFL, but they aren't taking away your first ammentment right to talk about it, though I'm sure that's what they would like you to understand it as.

The part about agreeing to not suing them invalid due to the fact it's right you have that cannot be taken away even if you agree to it. You can still sue Sony and presenting an electronically signed binding contract stating you won't would not even be permissible in court as a way for Sony to stop the lawsuit before it got started. Sony cannot make, change or enforce actual US laws - period. You have a right in the USA to sue whomever you please. I know this because I had signed a lease for an apartment that said I would not sue, but after months of nothing, but violations of the law on there part I brought the matter to court and the lease (contract) I signed did not forgo my right to sue the bastards. It's a bluff that can't be enforced.

Of course your chances of winning a lawsuit against Sony is about -50%

yeah i know they don't have a leg to stand on, also because they have so much money you wouldn't be able to forward it to a court of law anyway unless you have a lot of money.

Running custom firmware is not only illegal in many countries including the USA, but it breaks the TOS for PSN therefor Sony has every right to ban your ass. It's common knowledge that by installing CFW you are in most cases breaking the law and in 100% of the time you're breaking the TOS. I have no problem with Sony enforcing this and if you're upset the only person you have to blame is yourself.

if the courts rule iPhone jailbreaking as legal, then why can't the ps3 be treated in the same way? also if you are ripping your discs to the hard drive for convenience how is that illegal? i don't think a user should get banned for something like that.
on top of that you stated in a previous post that their TOS doesn't mean sheet and it doesn't even stand in a court of law, sony haven't got a leg to stand on and they are not above the law, just because they can hide behind a load of money does not mean they are gods, when you remotely disable a users ps3 and render it useless (damage of property) and disable a users psn account (and stopping them having access to their content that they paid for) that is classed as illegal and wrong, and they should be tried in the courts for misconduct and damage loss, sony are hypocrites, they say what we are doing is illegal but what they are doing is also illegal too.

I happily pay for PSN games. If I'm unable to access PSN, I'll find them somewhere else. Really smart piracy prevention.

Stop being ridiculous. You say games are too expensive, but before that you say they drop in price a few weeks after launch. You even have the option to buy used games. Mostly of all, you act like they are selling oxygen or air. The fact is video games are a luxury. If you can't afford them, that's not an excuse to steal them.

btw, on topic. i have a couple of ps3's. the one with official fw i logged in to day and updated from 4.25 to 4.31. when my account first try to auto-login i got one of those errors. i click back and tried to log in immediately after and was all good. so i'm not sure how they are detecting stuff cuz that console has never has cfw on it ever. if it gets banned for some reason can we sue SONY, nope don't think so.

In a court of Law Sony doesn't have a leg to stand on regarding the agreement of not suing them. Mind you this is Civil Court. Of course Sony's TOS (for the most part) is not actual laws, but something you've agreed to adhere to. If you break the contract then you are exposed to what happens if you do. Don't try to twist my words with the suing and the CFW issue. It's Sony's network, you agree to the TOS then you break it and the result is what they reserved them to be - banning you and also voiding your warranty which you already did on your own when you flashed CFW.

Sure, if you're upset you could go try to sue Sony over losing PSN due to your illegal modification which circumvents copyright protections which is illegal per the DMCA and specifically addressed in the 2012 revision. Good luck with that.
