You can sign a contract saying the sky is purple, however that part of the contract is void as is the part about not being able to sue Sony. You can give your written (or otherwise) consent to not sue them, but it is invalid as it's not legal to not be able to not sue someone over wrongdoing. It's just a scare tactic and if you do bring them to court and Sony tries to bring up the pre-mentioned contract it will be dismissed and the court case will continue. This is provided Sony actually provides a signed contract.
This kind of thing is the reason I hope one day that the PS3 is blown wide open. It's the reason why I hate Sony so much.

Just as I will not own a Xbox due to M$ policies I will not own Sony's next console, I do hope Nintendo or some other party steps up next round of consoles.
good luck hoping Nintendo steps up. Their only good console to me was the original NES. I personally hope Sega re-enters the console market. They made some mistakes, but overall I think they produced better stuff than their competitors at the time

I own the system. i should be able to do what i want with it. and since it is mine i should be allowed to modify firmware to my liking. well im never going to install cfw on my ps3 anyway. i guess it's just a nice bluray/ps2/ps1 game system for me now* *not playing ps3 games anymore*

I think you'll find that VISA, Mastercard and Amex might have something to say about this, as well as various national laws. But never mind Sony, if you don't do it yourself you'll just get the transactions charged back to you. Too many of those and your credit card processing fees are going to start creeping upwards.

That "no 3rd party peripherals" bit is interesting, but very vague. OK, extreme case here, but take your hard drive for example. The one that comes with your console is "sold by $ony", but if you upgrade it yourself to one you bought online (not sold or licensed by $ony), TECHNICALLY, you have broken the TOS and $ony now has a reason to close your PSN account. What about USB flash drives? TECHNICALLY, that would be a violation too. Terrible.
Maybe $ony plans on entering the storage device market soon like M$ did with their expensive flash drives?
