A Chicago man who bought Microsoft Corp.'s new Xbox 360 has sued the world's largest software maker, saying the new video game console has a design flaw that causes it to overheat and freeze up.

The proposed class action claims that in Microsoft's bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony Corp. and Nintendo Co Ltd. that it sold a "defectively designed" product.

I like the "very, very small fraction of units reported defective".... I wonder how many of the none reported ones are still sitting in the closet wrapped waiting for Xmas....

It happens.... hell look at Sony.,... they did make a crappy machine last time around... I love mine... but so many had problems from the get go with overheating... for both the PS and PS2.... a few changes and all was good....

I hope they make a little better appearance this time around... this could happen to them.

personally i dont think microsoft can come close to screwing up the 360 as much as sony have screwed up there ps2 by using shitty lasers, i love the ps2 but im not afraid to admit that its very badly made product

Well, I don't think it'd be so bad if they just released the XBox 360, and it was flawed...BUT count in the fact that they rushed it before Christmas so they can make $ is the bad part. If it'd come out in february, and everything is going to be flawed of course, I could understand. This was practically on purpose IMO which is dirty. Bound to know it wasn't ready....
Now, PS3 could, and probably will have some flaws when it comes out, but I'm doubting they'll be well aware before they ship some of the buggers out. I totally understand what Microsoft was TRYING to do, in which I can't blame them for rushing there product out there before Christmas so the little children will ask for the expensive POS , but they should have planned that long before christmas............

the funny thing is that they feel that getting out now gives them a big head start.... in fact acording to M$'s predictions... they hope to sell 25Million be for the PS3.... M$ has never even come close to that for even a 2 year selling cycle for the Xbox... how the hell do they expect that kind response from the users now?

Even if M$ sells 5Million units... the PS3 will beat it out before the end of it's release year.... hell the PS1 is still selling strong.... morons

i think the main problem is with the power brick. squeezing a full computer power supply into a plastic box with no ventilation is asking for trouble. if ms want the advantages of a small system, they need a custom archetecture like sony, which allows the system to run only on 12 volts. i think sony was really rubbing in in ms's face with the v12.

what i dont see is why ms couldnt get the power supply in the actual system. this would give the power supply much needed cooling. xbox managed it WITH an intenal hard drive, but xbox 360 couldnt fit it in, dispite the fact both units are simmilar sizes.

I think the important point is that Microsoft knew full well that these units were defective BEFORE they shipped and still have not issued a recall.
