    AutoMX: Past court cases have been about chips which can boot warez/imports as-is. Messiah stated that their chip wsa intended for legally backed up games and imports. The court ruled that backups and imports are not legal, and therefore a chip which has the sole intention of allowing you use them would also be illegal.

    A chip which has additional features would be much harder for Sony to take on in court. DMS and the likes have features like Dev.olution Mode which are obviously benifitial and not related to booting imports/backups. This is a much better legal ground to stand on since, as I said ealier, interoperability is a highly protected right.

    Sony willl be slow to take action in these cases because if they were to lose, precedence would be against them for any future cases. Sony's whole method of copy protection is deeply flawed. Had they made their discs virtually uncopyable, like GC, they wouldn't have a big problem with piracy. But instead they make the discs like any other and rely on the PS2 to decide what to boot/not boot. Because bypassing the protection inside the PS2(one way or another) is required to make unofficial software work on the PS2 console, this also opens up the PS2 to pirated software. There is not perfect way to have one without the other and that is Sony's fault.

    I'm not a lawyer, so don't take what I say as legal advice. However I can tell you that Sony will have a MUCH harder time going after these devices than they have with the Messiah stuff, precedent or no.

    I, for one, can't wait to see how it all goes down.

    Actually MS has used this tactic, see: Be Sues Microsoft or OS maker files suit against Microsoft

    Basically Be had a deal with Hitachi and Compaq to preinstall BeOS on a series of computers, along side Windows. At boot up users could dual boot into their choice of OS. Microsoft got wind of this and basically told Hitachi, that if they go ahead with this they will revoke their liscense as an OEM distributor of windows... So the vendor caved in, and as a result there are still some laptops out there with BeOS installed on the Harddrive and the users aren't even aware of the partitions existance... the removed the dual boot option, thus making the OS invisable, and all marketing of its existance was also kept under wraps...

    In any case, MS does use the very same tactics as being discussed... Just because you're not aware of them doesn't mean they don't exist.

    so ur saying that DMS TEAM will be like the xbox mod makers that release hacked bios like team xecuter for their chip?
    so they want to be the first to do it on ps2
    cuz they were last to create a chip for xbox...
    they want to be first on ps2 that use hack bios on their chip....

    Ya know.. I was seriously going to buy a dms+ just a few hrs ago, but **** that now that I learned about the bullying. This even makes me wanna yank out that xbit I have for my box and just buy that sexy new Xecuter.

    Kinda like leaving a woman for a younger one after you find out shes a whore... Team DMS being the whores if ya know what I mean.

    On a side note, sjeep and others are not that much dumb: a modchip that can't boot backups won't sell at all. I didn't believe one second that there wouldn't be any piracy-enabled firmware available one way or another. But I say their smartest move would have been rather something like having a download agreement of that special backup-enabled firmware, which agreement states that it is illegal to download it in country where booting backups thru a modchip is illegal (such as the UK). Many other download website have the same trick, even microsoft, when you want to download cryptographic stuff. They say "you can't download and install it if you live in a country which is listed below". Anyway...
