Sounds to me they are going the way the Xbox is. Sell the modchip without anything on it and let ppl download the bios for it. I haven't kept up with the scene xbox or ps2 in awhile though, so I'm not in the know.
it's harder for ps2 in a legal standpoint, since modchips can be legally used to boot the cromwell bios from a modchip. can't exactly do this with ps2.. this is a very supprising standpoint by dms.... it's discraseful their attitude towards vendors... good luck in them getting any sales at all
This is nothing like the situation with Microsoft. MS tries to get everyone to use their software, yes. But MS doesn't call up distributors and threaten to not send them MS products if they don't push MS over everything else. This would get them sued in a heartbeat. I guess maybe Divineo thought they could get away with it, given the shadiness of the modchip market in general.
Alot of people seem to be missing the point. The problem is not that DMS is making a "legal" design, or that they plan on releasing a "hacked" BIOS for DMS4 as a fake group. The problem is the tactics employed in order to sell their chip, mainly strong-arming resellers. This is a cowardly act and just goes to show how far DMS has fallen since DMS changed hands.
I think Da Brass mentioned the hacked BIOS stuff as a bitch-slap to DMS' plans to let them know that their attempts to dominate the market through intimidation will not be taken lightly and people are not going to just roll over and take it up the ass. It seems like both DMS and Divineo are both getting fat heads and thinking they own the scene...

Called me on that one Unfinity...right down the line. As I've stated before....this is a free scene and a community. People should have the right to choose which ever chip they choose. When they try to "muscle" and mold the scene they see fit, it's just plain wrong.
It's not like I'm looking for stuff to dig up. Vendors came to us to report these tactics....not the other way around. Exposing their little "hacked BIOS" plans is just the icing for a group that is forcing people to BELIEVE they are the #1 chip, vs. letting the community decide that they are the #1 chip.
I used to have a lot of respect for the DMS team when they debuted. My opinion waned when the internal fighting started.........which now all respect has been flushed down the toilet now after discovering this fiasco.
I'm sure $ony lawyers can easily defeat this new trick.
First of all they have a precedent to use in court (a previous court decision can be used as a strong supporting fact; basically they ask why fight the same case again). As far as courts go, mods are just about certainly illegal, and if there exists a way to possibly play backups then they wont even discuss it.

Actually, they do. WMP as default media player. IE as default browser. Not pre-installing certain competitors' products. Not shipping computers without operating systems (since that 'encourages piracy of Windows'; we all know no other OS's exist, right?). Look around.
Though, MS doesn't threaten to NOT send their products; they threaten to charge (even more) obscene prices, which is worse, since no computer manufacturer can tell Microsoft 'forget it, we don't need you' and stay in business.
To clarify my standpoint: I'm not one of those rabid anti-Microsoft lunatics. I'm just saying this is how business works sometimes.
