This is what I found so amusing...
It was made illegal in the UK first and then the US.
Australia was one of the last places for it to become illegal - so the shock most of you showed was amusingly showing your short memories...
Our ACCC was our saving grace until one dickhead down here got caught doing games as well and as such gave Sony the perfect opertunity to try and combine their case and make the chips illegal as well.
Sony just goes quite and then attacks again full on in chosen countries. I think the UK has the most stringent laws against mod chips. But with our new laws we wont be far behind.
They have a strange clause called - commercial value - a device needs to have some comercial value for it to "not" be considered a circumvention device - i.e. like a burner...
Strange thing to me is that as far as I am concerned chips do have a comercial value... go figure...
The UK does have strict laws on software Piracy and modchips, but the Government doesn't enforce them. I know of stores that openly mod consoles, and they have no problems with it.
The USA has similar laws, but again doesn't enforce them. It just likes to give the impression that it does by publicly ceasing the occasional Lik-Sang Consignment every now and again.
The only country that I can think of that really does enforce it's laws is Germany, and they are getting stricter as time progresses. Even still though, Gamefreax operate from Germany, and they never seem to have any problems with Sony, Microsoft or the law. ;)
Not entirely sure, but it seems you only get in trouble if you sell a device designed specifically for circumventing....so......I guess the next step is to sell a blank chip that can *technically* serve various purposes, some of them which are legit--then it just gets flashed to be a modchip by the user.
Sort of the same idea behind the reflashing of a set-top DVD player connected to a VCR because the TV has no RCA/Svideo jack. You flash it to remove Macro detection so you can view DVD's on your TV through the VCR, or buy a box that does it through the RF jack. It's only illegal if you use this *feature* to tape a copyrighted movie.
Just a thought......maybe not...who knows. But, if there's a will, there's a way.

That's because France doesn't really have a problem with it.
The UK has recently become a hotspot for developing mods in the first place ie the NEO Mods and the cracking of the XBox. Germany has a reputation for developing some of the finest crackers in the world, and also has very strict laws on Software content.
If something causes the French to look into the matter in further detail, then you will most probably follow suit.

We have here 3 mod maker ( R.ipper team for exemple ), France is classed 2nd in The Europe mods market, so that is not the "cause" of our liberty
France have many serious law alowing the modification of electronical device including the breaking of the hardware anti-copy protection.
We intended many suit against Sony / warner music etc.. cause they protect their audio cd against the copy :)
