This is funny, I live 2 blocks from that store, I went in there looking for a pre-modded ps2 because I knew they had modded xboxes. I left and bought a PStwo at Target. THen a few days later they get raided.
all PS2 modchips are in fact illegal under the DMCA, under the circumvention device prohibition. PERIOD. Even the famed "antipiracy modchip" is ilegal, as it circumvents the territory restriction. The fact that there are legit uses, which normally helps your case out on the fair use front MAKES NO DIFFERENCE, as evidenced by judical precedent in the DECSS case. The judge stated flat out that fair use DOESN'T APPLY TO DMCA VIOLATIONS! This means fair use is not a defense to DMCA violations anymore!

X-Box chips, on the other hand, are different. They are flashable BIOS replacements. The all come shipped with legal code in them for booting X-Box Linux. Therefore, they are unambiguously LEGAL as manufactured. If the user uses an illegal flash file then it's their responsibility. You can even un-protect your console and flash it's own BIOS to mod it yourself without buyng a chip.
