You're asking if people get banned for playing online with a PS2 and backed up games. I can't answer that, but asking this to find out if you want to get one console over another is retarded at best. You should look more at the games offered and the cost of entry. You know, the actual content and how much you need to pay.

You don't know sh*t about my intelligence. I think that both systems will have many good games, but I want the console that is the cheapest for me, and I want to play online. That's why I made this thread, I can't see anything wrong about this.

The previous actions by both companies are no way to judge the next generation actions.
Sony didn't ban people on ps2 because it was much more difficult to detect a copied disc. Microsoft checked the xbox ROM to determine whether the system had been hacked. On the 360, microsoft isn't just kicking back, allowing people to steal games. They're either A) Having trouble identifying hacked firmware or copied games, but working hard at doing so. or B) Collecting usernames and system ID's until one day where they'll mass ban, just like on xbox. What they're not doing is letting it slide.
So, don't worry about company policy, because they'll be identical: If the user can be detected, they will, and they'll be banned. Choose the system you want to play more.

I highly doubt it since the game developers have to set up their own servers for their games.
