Is selling a board with PSGroove pre-loaded not legal?

Hey,

I've noticed almost all the boards available do not have PSGroove loaded on them - Why is that? I thought being open source software there would not be an issue selling boards with PSGroove loaded?

huh? all clones have psgroove loaded in the board..

but if you're talking about dev boards.. well... uhhhh because dev boards are not just used for psgroove.. so it's the buyers decision what to flash to the board..

Yeah ti's true about the clones, but all boards on ebays clearly being sold for PSGroove use don't come with it loaded....

oh i see.. maybe they don't wanna spend time flashing the files to a lot of boards.. or maybe they didn't know that psgroove is open source.. a lot of seller's doesn't really know about these things.. they just sell because they heard it from someone that that board can be used to hack the ps3..

Well here in the US.... selling it with PSGroove pre-installed violates the DMCA.. so yeah illegal here.

Use common sense. The clones operating in China have nearly nothign to fear, aside from loosing potential distributors/customers due to it being banned in AUS and sony filing a law suit now in the states. Basically unless the Chinese government decide to allow sony to sue then it's pretty safe for manufacturers in China

If it is blank for a development board then it's not illegal in anyway as it's sole purpose is not psgroove. Not pre-loading it with psgroove keeps people/businesses out of potentially unwanted trouble.

PSGroove is legal, free, open source software. How could it possibly violate any laws?

Its a grey area just like a modchip, it circumvents the PS3 security. Thus under the DMCA make it illegal to distribute preflashed on a chip.

Hi all,

I think of a PSGroove loaded device as equivalent to a modchip which are legal for sale in my country and the states. I can't see how they are any diferent?

Gray area like a modchip? You do realize that modchips are legal in the US, right?
