So, with jailroken PS3's, and new games to be released soon.. Are we to expect mandatory updates for games to be played above 3.41?

FIFA 11 is going to work and that is coming out October 1st. Don't know about games beyond that. Of course that's just the first batch, they'll probably make the later batches require 3.42 and up.

Although my wallet isn't too thrilled at the concept that I'll have to buy more hardware if it cannot be ported like the current hacks...

Just because a review copy works doesn't mean that the final game will work.
I think that something like that happened for HDLoader before.
Even if Sony fails to block the Jailbreak... some game devs may try something really stupid.... like what they did to kill HDLoader - they took advantage of the quirks in the drivers the game had, making it difficult to replace those drivers without breaking such games.
In this case, they may try something to force users to upgrade their firmwares.

Yeah, you can bet your ass that games companies will start to include more robust anti-copying measures on their BDs.
But if you think back to the PS2 HDL days, this just played right into the cracking groups hands and all it meant was that we then had to download 'ripped' / 'cracked' copies of the games that had been released by Razor1911, Fairlight, etc, etc.
Mind you I don't fancy the idea of trying to download a 24Gb iso and then find it didn't work.
