i personally know the guy that got arrested.
he didnt get arrested for modding the system, modding your hardware is completely legal. the illegal part was that "patrick" pei cai was adding free pirated games to go along with his work. since he was giving away free xbox games with the hardrive upgrade it got him busted for piracy.
another note: apparently he didn't get "busted", from the story it looks like he got snitched by some asshole that thought they could make a couple of bucks of pei's work. they tried to sell the pirate xboxes at a general game store and got busted for it. those @@$holes got a good modder in L.A. arrested just for being greedy.

There was another Pandora Xbox in another state that got busted for selling Modded Xboxs with games on them. Was Pei associated with that group?

serves them right. if they are including games on the hdd when they do the mod job, they deserve to be jailed :(
