Nintendo Warns Against Playing Pirated Games On The 3DS; Threatens To Brick Consoles

Nintendo is making it clear they do not support playing pirated or non-region approved games on the 3DS. Japanese retailers have been warned, Nintendo will disable any 3DS console that has illegal games detected on it. The console would be bricked via firmware update. The 3Ds launched last week in Japan and the American release will take place at the end of the month. I'm sure we can expect to see a similar warning from Nintendo once it hits shelves on March 27.

Many retailers in Japan have already warned their customers; issuing their own warning, stating they will not buy back a 3DS with custom software. According to GoNintendo, Japanese game chain Enterking posted this warning on their site.

    The flier roughly translates to:

"Dear customers who resell Nintendo 3DS "

    "non purchase able 3DS system"

In case if you use equipment which is illegal or unapproved by Nintendo or if you do customization which is unapproved by Nintendo, there is a possibility that Nintendo 3DS become non bootable by system update.

    - From Nintendo 3DS terms of agreement

Because of terms of agreement above, Enterking refuses to buy 3DS system with record of illegal or unapproved equipment.' "Request to format before you sell"

Do you think Nintendo should be able to disable the 3DS if they detect illegal software? The 3DS won't be able to play games that aren't approved for your region. Could you have your 3DS disabled for playing an imported game, even if you payed for it?

yeah why not, sony is acting like a jerk and gets away with it - so it is only a matter of time before N or any other company act in a similar way...
In time, Fire will fade ... and only Dark will remain

These companies sure know how to push people out of their markets! I was gonna get two of these on release for my girlfriend and I, but now **** that! They wanna ban me for hax then fine, but bricking consoles: wtf?!?!?! I would never buy something from a company that intentionally destroys products after selling them to customers, for any reason.

Uhm, my understanding is that the 3DS was already hacked using R4i carts. And my second understanding, is that R4i carts don't change anything on the system and have their own memory for storing the games. So, in reality, wtf is Nintendo hoping to achieve here other then bringing recognition to the fact that the system was hacked before it's even officially released everywhere.

I'm pretty sure that information is false.

did this me something to you ; fraud and abuse computer act.

You can sell something to someone and break it beacause he is not use as it mean to be. Even if you don't own the software on it, you have bought the hardware.

Acessing a system that you don't own ,event if you the right to access , to renders it useless without the consentement of the owner il purely wrong

Yet the Android SDK provides this facility to app developers and nobody complains: Manifest.permission | Android Developers

Lol, I'm guessing as long as you buy a good flashcart and not a $5 one, you'll be fine.
And legally, bricking consoles is never a good idea for a company, althought that's obvious.

Yes, A 3.55 "jb" (cfw) is available, no >3.55 "jb" or cfw yet.
Yes, A 3.55 downgrade is available. But not to lower than stock firmware! (What it came with)
No >3.55 downgrade is out there yet.

Hopefully (and judging by the official website definitely) my AK2i will be compatible with the 3DS through an update to the card firmware. I was considering a CycloDS iEvolution for the DSi mode support but unless it also works in 3DS mode I'll probably hold out until there's a card that does.
