Not both. Loading backups is not illegal. Loading software which you do not have a license for is illegal. The backup manager was created illegaly, so until a backup loader is coded without the Sony sdk, the steps are illegal, the end result is not. However, if deleted within 24 hours, it can be deemed as "for educational purposes."

False. This is a common misconception. According to the DMCA in the US (among other laws in other countries), making backups of your games IS ILLEGAL, because you have to bypass copy protection measures to do so. Everybody would like to think that you can make legal backups, but you can not. I have a copy of Modnation Racers on my PS3 and a disc copy on my shelf, but the backup is still illegal. (Whether somebody will actually prosecute you for backups is another thing entirely.)

untrue. you can make a backup of any PS3 game by ripping the bluray with a computer. encryption is left in tact- now doing anything with the backup may be challenging.. but you don't have to break anything as the game discs are clearly readable in a bluray drive.

as far as i know making a backup for personal use only aslong as you own the disk is legal. its even in the back of the manual of your games

But you broke Sony copy-protection methods by Jailbreaking the PS3. And no, not all data is directly readable by any Blu-Ray drive. That's why you have to rip the games using the PS3 Blu-Ray drive.
