I wonder if i decide to upgrade my PS3 to 3.50 (it's already Jbroken), and get online to PSN (i want to play online games again). What would happen? Ill get banned?
What if i've formatted my PS3's HDD and redo i clean installation of the OFW, will there be traces that my PS3 was once JBroken?
Please i would love an answer.

At this moment, it's been discovered that there are traces of Dev mode and the software installed on it all over the HDD (PS3 registry and loose files) and possibly the onboard NAND. The latter of course would depend on the version PS3 you have but my advice would be to wait.
Wait until more is known about exactly what the PS3 sends back to base and where it's all stored on the PS3.

I have the European Phat 80GB PS3 model, if that is of any help. And propably you are right, i should wait, so when all questions are answered to decide.
Because if the data (History, game lists etc.) is only writen on HDD, a simple format would wipe clean a JBroken PS3, but if the Onboard NAND keeps track of that too....
Does my model keeps data on the onboard NAND?

That model has the PS2 back compat and was produced before they started skimping on components so it has the larger NAND chip with 256 megabytes of flash memory to store firmware, using two NAND 128MB Samsung flash chips.
I'd strongly suggest waiting. The older models reportedly keep license information on board and some other tidbits.

Just imagine a hasty action of upgrading the firmware to 3.50, getting banned on the first attempt to connect over the PSN!
I would have a Up to date console banned! That would be a shame really and waste of money most importantly

I think the odds are extremely slim.
Sony doesn't want you to stop buying games because you’re PS3 got banned. However by staying non-legit you won’t be buying new games either as they won’t work. Sony loses money either way. What Sony wants is to entice users to go back to being legit. They don't want to trick you and then ban you once you do, as that’s a loss of potential profit to them....

However the people they DO want to ban are those who find out how to play online while being non-legit.

I don't think Sony have anything to gain from banning. There isn't a paid service like Xbox Live to protect. They have no history of banning from any of the previous consoles, including PSP which many people switch between official and custom firmware frequently.
Nothing wrong with playing it safe for now of course, but I can't see it being an issue.
