NEW GAMES WORKS?

I have slim 320gb, i went from CFW 3.55 to OFW and did a backup and changed hdd and i installed ofw again and restored and then i went to Kmeaw 3.55....everything is working fine, i have some questions
and i will be appreciate if anybody can answer them, i have installed 1terabyte hard drive in my slim, the only model in market is the Samsung. I know that it would show me like 931gb....and its normal.
But after i installed new 1tb hdd and it showed me like this 775gb free of 931gb.......where have gone all those GB space?
My other question is all new games coming out like captain america and so on only works on 3.60 and so on, alot of people have 3.55 and they cant play it right? so why people dont patch it so we can play too? or only those big titles and worked on and
patched so they become compatible with 3.55? can anybody please explain me?

It's not possible. The developers who made the game can patch them, but we do not have the tools to do that.

As for the hdd, rebuilding the database from the recovery menu may fix that, but i am not 100% sure.

I think the PS3 reserves a percentage for indexing and other stuff like 12,5% I just found on google.
