I have numerous ps3 games examples ill use is infamous. If I own the game infamous but bluray drive doesn't work on my ps3 is it legal to have backups and is it illegal to download backups? I don't think asking this is against the rules of the forums if so please delete my post.

downloaded games are illegal here .
but making a backup of your own game and then install to PS3HDD its ok .

wait, i think this guy brings up a valid point. if you actually own the disc, the laser breaks in the console, you download it and install via ftp... would the only issue be the fact that you downloaded that content from the web?
i mean, if the police came to your house, searched it, found the disc, then determined that you had the data saved to your ps3 hdd, can they actually take legal action against you?
i don't think so; maybe if they could prove that you actually downloaded the content to your pc they may have something against you...

thats what we mean by making up your own backup and then use later without needing the original disk .

The problem is when the data you downloaded is now shared among people...
and make use of P2P for example, so to have it is not the real problem here
if you own the disc, but to share it is where the problem is.
And making backups are also illegal in certain countries...
Did you know that recording a single tape from radio for example is not LEGAL !

Yes, the fact you conspired with another person (the uploader) to pirate a game would be the issue. Having your own backup you made for yourself is OK, but once you share that backup your classified as a pirate.

If they have proof you downloaded it from an outside source, yes they could.

Of course they'd have to proove it, but it still doesnt make it any less illegal to do in the first place.

No it would not be legal. Sharing copyrighted material is piracy and that is illegal no matter how you 'justify' doing it.

well why would you bother to upload your own game to somewhere on the net rather than PC ?.doesn't make a sense right ?
and of course since you cannot proof us then it will be illegal .

if you own the disc, i think the problem that comes into play is "did you download the data?"
It is the same for anything done illegally, you only get in trouble if your caught.
