I'm pretty sure that jailbreaking yerr PS3 is a violation against the TOS.
They will likely do what MS did, gather data for a long while and then hit us all with the ban hammer. And we will, much like the 360 users, have absolutely no right to do anything about it. Well, except whining about it.
As I understand it, the best advice right now is to block Internet access all together. People that have had their consoles connected while in debug mode clearly are at risk of getting banned in the future.
Well, I thought it was rumored the the logging capabilities of the PS3 allowed for a pushlist or some kind of boot logging that can record whether or not the JB has ever been used. If this is true then that may cause a problem when you update or bring it back online. Dunno if this is true or not to be honest.

I take it you have never read a TOS, as most TOS agreements say something to this effect;
"Use of the hardware/software for anything other than its intended purpose is a violation."
So let us use some grounded logic here shall we. Homebrew doesn't work out of the box on a PS3 because it wasn't intended to. Since it was just used for something unintended, the TOS was broken...end of.
