So I had a HDD failure on my PS3 and lost all my PSN content but my act.dat etc is all still there as I have a 60gb 256mb NAND model. Now I also own a 3.60 slim that has all my DLC already installed. If I did a backup with the PS3 utility for all the data and tried to transfer it to my hacked PS3 (which has the exact same user name and act.dat) would I be able to do this so I can play my PSN content again? I am just worried it will not work for many reasons, the main one is that if I do so will it make me update that deck to 3.60?

With the info you just gave, the answer will be no unless you got a demo/game from PSN. Any DLC will have to be activated with the account, which you can't do on 3.55. The ONLY way you wouldn't have to connect to PSN is if you had a backup of you xregistry.sys which contains your PSN info. Since that file is on dev_flash0 instead of the HDD, your DLC won't be activated.

I have all my dev_flash backups but I said in the post all my NAND was left untouched as in all the PSN activation content is still there. Dev_flash1-3 were not touched as I have a 256mb NAND PS3 not a NOR flash. Besides I have a backup of the dev_flash 1-3 folders as I make one every week. So now with this knowledge do you think it will work or ask me to update once it is applied since some of the 3.60 data would be copied from my slim PS3 as some of the FW is placed there on that type of model.

It shouldn't ask for you to upgrade since it's only backing up info on from the HDD and not the NAND. Your psn downloads SHOULD work. If they don't just move the xregistry.sys back to /dev_flash2/etc/ (i made a mistake in that previous post, its not in dev_flash0) and all your PSN downloads will work

I don't think it's going to work with the backup utility, you might get accounts and gamesaves (I don't remember honestly), but I know installed game data will not get restored on a console that did not create the backup. You might be better off trying the data transfer utility, which I know will transfer installed game data.
Transferring from 3.55 to 3.60 will work fine, but going from 3.60 to 3.55 (what you need) it will tell you to update the other system. The rebug 3.60 spoofer will let you do it though, I've done it once on my launch 20gb. I was worried about formatting while using CFW and the spoofer but it all went fine. If you use a gigabit network switch you can leave the ps3's plugged into that (works for me atleast), otherwise you'll want to proceed with the direct patch cable connection like the instructions say.
This is a bit OT, but what kind of hard drive failed on you? My CECHH 40gb drive just took a crap recently, it's a Seagate ST940210AS. I've only owned 2 seagate drives in my life, and they've been the only two failures I've had to deal with.
