Pre-mod systems across Europe

I heard that UK customs are seizing modchips and obviously installing them has become illegal, but what would prevent someone from getting a pre-mod system from France, Spain, Germany, etc.

Shouldn't EU laws allow stuff to cross borders freely?
Are there different PAL formats or something like that?
