DMS3 V9 in a V10 strange eject

Has any one had or heard of this situation.

I installed a DMS3 V9 in a V10 PS2 and it works great. But when it has been turned off with the switch on the back or left in stand by for a while, I can?t turn on the PS2 by tapping eject. It won?t do anything until I hit reset then the unit will turn on and then I can tap eject and the tray will open. Then after I have done this I can put the unit in standby and with out waiting tap eject and the unit will turn on and eject. Is this a firmware issue with the 1.8 flash or could it be something else?

I've seen 1 or 2 of the V9/V10s of mine do that too. Kinda odd, but it works eventually.
