Is That Breakpad Necessary In The Slimlines?

there are obviously different versions of the v12 PS2 slimline cases...
so, im trying to swap a newer version of the guts into the older case... i have already modified the dvd area so the laser can move back and forth freely [if not, it just gets stuck and makes a horrible noise...].
so, the only thing that keeps this from working is that dvd "breakpad" located at the rear of the drive, next to the laser housing. when i push this back so its not touching the disk at all, it works fine. the game loads and runs...
my question is: if i remove this or keep it pushed back, will it cause any type of damage or F up's? right now, it doesnt seem to be messing anything up. it actually makes it work perfect... the dvd drive actually does all the spinning and slowing down of the disk... it even stops the disk on its own without the breakpad...
here is a photo to further explain whats going on here: PS2_CASE_SWAP.jpg
thanks guys, hope someone knows about this ;]

This may sound simple, but have you tried this with the case lid closed? When it's open, the brake pad will very slightly run on the disc, causing it to not load. It gets moved back just a bit when closed, allowing normal movement.
