  • SEN: TOS and Privacy Policy

    With recent news regarding the re-branding/renaming of the PlayStation Network (PSN) to Sony Entertainment Network International news comes regarding new terms of service and other binding policy agreements. Below are some extracts from said terms of service some of which include master accounts and subsequent subaccounts that include provisions for minors, the class action waiver, unauthorized hardware not sold by Sony, unauthorized account usage and hacking to name a few.


    A few extracts that one should note:

    • New terms that explain the location-based services offered through the PlayStation Vita system. For parents of minor, subaccount holders your reacceptance of the Terms of Service and User Agreement and Privacy Policy affirms your consent to your subaccount holder’s user of these services on the PlayStation Vita system.
    • ACCEPTED ONLY BY AN ADULT OF LEGAL AGE
    • ARBITRATION AND CLASS ACTION WAIVER
    • you will not use any unauthorized hardware, including peripherals not sold or licensed by a Sony company
    • there may be charges associated with certain online content or services available through Sony Online SEN First Party Services.
    • SNEI has no liability for any unauthorized usage of any account.
    • refrain from abusive or deceptive conduct, cheating [+1], hacking, or other misuse of Sony OnlineSEN First Party Services.
    • You may not use, make, or distribute unauthorized software or hardware,
    • You may not attempt to hack or reverse engineer any code or equipment in connection with Sony Online SEN First Party Services.
    • If you do not consent to allow us to share your personal information with third parties for the purpose of providing you with access to Sony Online SEN First Party Services content, you will not be able to participate in any Sony Online SEN First Party Services.
    • SNEI has no obligation to reverse or refund unauthorized charges made on your credit or debit card.
    • Subscriptions renew automatically unless you cancel the subscription. The cost of each subscription will automatically be deducted from your wallet at the beginning of each subscription term without further notice to you.
    • your wallet will automatically be charged the cost of the subscription at the beginning of each subscription term without further notice to you.


    With that being said, what are your views regarding this.

      right so let me get this straight.someone finds a flaw in sonys network (lol)hacks into your account and steals your money,its not sony's fault and you can not sue them to get your money back.wow where do i sign up then?

      Seems senseless to throw away the PSN brand despite the trouble they had last spring. Microsoft would NEVER try to rebrand XBox Live.

      If you do not consent to allow us to share your personal information with third parties for the purpose of providing you with access to Sony Online SEN First Party Services content, you will not be able to participate in any Sony Online SEN First Party Services.
      Everyone should be scared. What gives them the right to share personal information with anyone? I can tell right now, that even if PSN is restored to CFW, I will never use it. It's disgusting for them to think they can do that for any reason

      As much as I like Sony but this time they took things too far. Is this legal to do?

      unfortunately it is legal to do. all a lawyer or a judge will tell you is don't agree to the terms of service.

      This is ridiculous. Sony's taking things too far this time. Why should we continue to use their services if they're going to share our personal information with third parties? Especially if they're not listing off every single party they're sharing with, and what information they're sharing.

      I suggest we all email Sony and demand full records of what personal information they have shared, will share, and who they are sharing it with. While you cannot ask for who they've given other people's information to, you can ask who they've given your own to. Because it's your information, they legally have to oblige and give you the full documentation of it upon request. I'm sending them an email right now.

      Hey do you guys know whats funny when 95% of people see the TOS and Private Policy they will think blah blah blah and blindly sign their rights away be honest who is really gunna read all of that when you are itching to play some COD or something else lol

      @Darkman-PSG - reminds me of the South Park episode "Human CentIPAD" where kyle doesn't read the TOS of iTunes and gets his mouth sewn to an asian man's butthole and a woman sewn to his. Always read what you agree to

      @JonahUK - it wouldn't be so bad if we at least got a reach around or dinner first

      @Thorn - you can opt out, but you'll lose PSN (or SEN, whatever they want to call themselves)

      Sadly, Sony was already doing it prior to the new TOS. The new TOS just gives them the right to do it legally now. If you agree to it that is. Open MFW click on Secure privacy and see some of the sites that was already taking notes of your use of the PS3. So now it's legal. Tell the me difference from what is now and what was then?

      I seriously think if you have a problem with it. Use some stupid throw away email like msn, hotmail, yahoo. Don't use the Plus, Netflix, TV services, and Music Unlimited crap. Don't buy PSN/SEN access cards. Keep your shit to a bare minimum. Use it only for playing games online. Volume speaks words. Not some body that likes talking out the side of their neck.

      Personally all the ppl here are going to do is NOTHING. Their gonna bend over just like the rest of us and say yes to the TOS. blah blah blah blah

      I'll be one of them. The only difference is, I don't use it for other(Read Above) shit. I don't care to have ppl monitor my actual things I do. All their gonna monitor on me is, Oh he's been playing such and such game online for so many hours. whooopie!

      Under Romanian law, this is highly illegal, and I think it is in every country on this earth. A contract in which the clauses cannot be negotiated directly by the signatory parties is declared an abusive contract!
      You can accept it any day, any good lawyer could and should bring down any contract like this in less than 5 minutes!

      And yeah like Quake69 said overall I don't pay for any subscription or any thing other than PSN content that I use on my official PS3 so I guess this wouldn't bother me too much I guess

      You can sign a contract saying the sky is purple, however that part of the contract is void as is the part about not being able to sue Sony. You can give your written (or otherwise) consent to not sue them, but it is invalid as it's not legal to not be able to not sue someone over wrongdoing. It's just a scare tactic and if you do bring them to court and Sony tries to bring up the pre-mentioned contract it will be dismissed and the court case will continue. This is provided Sony actually provides a signed contract.
