  • New Sony TOS and Privacy Policy, again?!!?

    Sony is back with another TOS and Privacy Policy, and this time they want your SOUL!. Other new updates, Sony Network Entertainment America Inc. (SNEA) is now transferring all accounts to Sony Network Entertainment International LLC (SNEI), Qriocity has turned into Sony Entertainment Network (SEN), and purchases have turned into "licenses."

    I was a Sony FanBoy, and all I got was this lousy t-shirt!


    Here is the email.


    A new addition called BINDING INDIVIDUAL ARBITRATION has also arrived, and to quote a tweet from KaKaRoToKs :
    "Section 15 (page 17) is a class action waiver and a "I will never sue sony" clause AND it's binding FOR LIFE!?!?!?!"
    Basically agreeing not to sue them in any future class action lawsuits. Real classy guys

      Wow... this stuff is just getting dumb... I should wright up a long TOS that no one would read and have in it... "If you agree to the TOS i get to take all of your money in your bank at anytime without your consent or knowledge, You can not sue or place any legal action against me and it's binding for life." Make that a Virus where you can't get back online without clicking OK and there you have PSN....

      All folks, to hate them more, do NOT accept these NEW TOS, but buy an E3 FLASHER and downgrade to 3.55CFW!!!

      Forget it! no way in hell I'm gonna lose the posibility to play ultimate marvel vs capcom 3, gundam extreme vs or every single new incredible game coming out this november and december.

      They can't do me s*** so what's the problem? I don't use credit card, i use psn targets so i'm gonna accept whatever they put if that's the only way to play umvc3 gundam exvs, uncharted 3 and so on.

      Peoples should gather together and boycott this service to stop this nonsense. If everyone just accept this and move on without taking action, Sony is going to shit in costumers face for a long time. The problem, is that at least half of "costumers" are kids or retards who don't even read TOS, so they just press "accept" instantaneously. Welcome in 2011, where Kevin 14 y.o is the main target for Sony.

      I don't give a ****. TOS/EULAS/whatever aren't legally valid contracts. They're worth less than toilet paper in court, they could even say that I had to surprise buttsecks Kaz Hirai if I was caught cheating on PSN that it wouldn't mean shit.

      Man, I'm getting close to the point of being too annoyed at Sony to never buy any of their products aswell. It's a shame, because I always loved their consoles

If the Class Action Waiver clause is found to be illegal or unenforceable, this entire Section 15 will be unenforceable, and the Dispute will be decided by a court and you and the Sony Entity you have a dispute with each agree to waive in that instance, to the fullest extent allowed by law, any trial by jury."

      Is that like they are saying we don't know if our crap is legal. We are just saying it anyway in case something happens?

      What were you all expecting?

      Sony severally over reacted to the Jailbreak, settled out of a court case they started because they were wrong, and now they want to make sure they don't screw up again.

      Under current law, clause 15 is legal and in use by a few other BIG companies. Companies shed their liabilities by becoming corporations. The only thing that could hurt them WAS class action lawsuits.

      Lets face it. The only way the poor and medium class people can win now is to simply euthanize these powerful people. In that case they purposely put a lot of us between them and us.

      The other choice is to represent ourselves during a court case, something the rich have gone out of their way to scare the people from doing.

      Radical solutions, or ignoring decades of propaganda are generally the only real solutions. Boycotting doesn't work unless everyone does it. Good luck with that one.

      There's a simple solution here; do not accept the new TOS and you retain your right to sue Sony in a class action suit. This is what I'm doing, and if a class action suit comes around, I'm gonna be in on it. They can only screw you, the end user, if you let them. You've got no obligation to sign this contract, and any idiot who would sign their rights away to play games deserves whatever they get.

      I, for one, deleted the PSN account from my PS3 so not only can I not accept the new TOS, nobody else can either. Of course you could always just lock out contact with Sony/Pushlist and you're good anyway.

      Xlink Kai is a suitable replacement, especially once JFW DH comes out.

      This Section 15 shall survive any termination of this Agreement or the provision
      of Sony Online Services to you.

      that's is why i believe that either you enjoy all the "benefits" OFW offers or you jailbreak your device and forget about those "benefits". they are allowed legally to change their TOS and even if it's not fair, legally no one gives a shit about the scene, except of course the ones that support it. i for one will not use PSN ever again, besides, if free servers exist to play your games online why would you get on your knees and suck on sony's dong.. F'That

      i hear people complaining about the new TOS but i have 3 solutions for you and most may not like either one of them. 1) buy another ps3 to have as a legit machine and one for homebrew. 2) e3 flasher. works every time. 3) Buy an Xbox 360. IMO, PSN access sucks donkey balls compared to XBL anyway. Ps3's are for sale at gamestop for 99. i might go get two just to test homebrew. Kmart do have lay-a-way for those who say that they can't afford another ps3. guess i'm done. back to regular programming. lol

      Any class action case will probably get shot down just like the huge Walmart class action discrimination case. Corporations own the courts.
