  • Geohot's Lawyers Move For Dismissal + Sony's Response

    The legal battle, between George Hotz (geohot) and Sony, continues to unfold in the great state of California. When we last covered this subject, the court had denied Sony's request for a restraining order, as the judge felt California did not have jurisdiction over the matter. Sony has been fighting this issue ever since, arguing that California does indeed have jurisdiction. Sony's latest basis for this argument, is a PSN account with the username "Geo1Hotz", which Sony is claiming as George Hotz's account. However, geohot's lawyers are shooting down these claims, and are moving for dismissal of the case all together.

    Below are the highlights from the latest leaked court documents:

    The only evidence it has put forth to prove Mr. Hotz has entered the PSN Agreement is an improperly authenticated screen shot of a PSN Network account with the username “Geo1Hotz.” Declaration of Gilliland Exh. A. Mr. Hotz does not own or have access to this account. Mr. Hotz does not live in Rhode Island, does not use the name “Geo1Hotz” which, in contrast to Mr. Hotz‟s common handle, utilizes capital letters and a numeral, and Mr. Hotz was not born in 1995 as in the screen grab. Id. Sony further falsely states that Mr. Hotz is “reffered to online as „GeoHot.‟” This is untrue. All exhibits submitted by Sony purport to show that Mr. Hotz goes by the internet name “geohot” without any capitalized letters or numerals.
    In the present case, Sony cannot demonstrate that Mr. Hotz‟s activity could even arguably be construed as expressly aimed at California. To the contrary, the sole alleged tortious activity alleged in this action involves Mr. Hotz-- who is located in New Jersey-- purportedly improperly accessing portions of his own Playstation Computer-- which is also located in New Jersey. Sony's primary allegation is that Mr. Hotz violated the circumvention provisions of the Digital Millennium Copyright Act (“DMCA”) by allegedly circumventing control access to the Playstation Computer. Sony also includes various other inexplicable claims for good measure, including Mr. Hotz violating the Computer Fraud and Abuse Act and the California Computer Crime Law for allegedly "exceeding access" to Mr. Hotz's very own Playstation Computer, as well as for Mr. Hotz purportedly "trespassing" on the very Playstation Computer he lawfully purchased and owns. Sony also alleges that, by engaging in such conduct, Mr. Hotz has breached the PSN TOS (which is actually not applicable to Mr. Hotz as demonstrated above). Nonetheless, this suit centers around the allegation that Mr. Hotz improperly accessed portions of his Playstation Computer.
    Sony thinks that an unnamed defendant called “Bushing” resides in California but this person remains a Doe defendant, is not named as a defendant, and has not been served with process. Further, all evidence put forth by Sony regarding “Bushing” is improperly authenticated hearsay. This court should not rely on Sony‟s speculation of a Does defendant‟s place of residence to assert jurisdiction over a nonresident who is actually named with an address that has been identified, in New Jersey. Further evidence in this matter is found primarily on the internet.

    Contrary to Sony‟ assertions, most of the physical evidence and Mr. Hotz himself, are located in the state of New Jersey. The bulk of Sony‟s claims regard evidence found on Mr. Hotz‟s media devices and in Mr. Hotz‟s testimony as a witness. Other than those items, the bulk of the evidence Sony puts forth may be found on the internet which is accessible just as easily in New Jersey as in California.

    Sony relies on the unsubstantiated residency of the unnamed defendant “Bushing” as a basis for California being the best forum. However, “Bushing” has not been identified, named, served, or connected with Mr. Hotz in any way that would warrant bringing the only identifiable defendant out to California. If “Bushing” does exist and can be ascertained at a later date, Sony would have to amend the complaint to properly name him/her which has not occurred. Thus, New Jersey is an alternative forum that exists to provide Sony with adequate relief. If Sony can obtain jurisdiction by merely including a hypothetical defendant by the name of “Bushing” that may live in California, then any Plaintiff can file suit in California and obtain jurisdiction by adding “Bushing” as a defendant.

      Stupid piece of shit claims that he hacked the ps3 because Sony removed the OtherOS. But Sony removed OtherOS because Geosux was claiming he found a way to hack the PS3 via a glitch in OtherOS, thats the reason why OtherOS got removed in the first place. We lost Linux because of this lowlife.

      All you idiots crying about Sony being evil, why do you buy a ps3 then? Go play on your shitboxes. Atleast Sony is trying to make exclusive games wich u want to pirate.

      I hope Sony bans all the idiots that went on PSN, the ps3 scene shouldve been only about homebrew and emulators.

      actually, i bought my ps3 on the date it was released for the reason that i could use linux and play games in full HD

      in january 2010, geohot found a glitch in the PS3's OtherOS feature while playing around with the feature. thus, Sony removed it.
      now geohot is not only working on re-adding OtherOS but also enabling omebrew.

      Geohot never intended to enable piracy. he actually disabled it.

      Yea geohot is against piracy he is all about homebrew. he disabled the feature to beable to copyright things but he knew there were going to be other devs out there that would find away to work around his. and left it to them to do copyrights. imo sony sould be going after those guys not hotz.

      Here's the gist of it. Sony is trying to say that GeoHot agreed to the Terms of Service (ToS) by accessing the PSN under Geo1Hot. GH's lawyers are saying that that username doesn't belong to him because he doesn't live in Rhode Island and he wasn't born in 1995.

      @Turkish. Actually the only thing geohot did to the otherOS was try to gain access to use the video card to its full potential. Research a little bit before you go crazy on a forum. As for pirating games, that's another situation. I don't like that people will be able to go online with non-purchased games. Then this will bring in the chance that these games may be modified to allow them to do things during game play that are not normally allowed. Different guns, unlimited ammo, just some examples of what could happen. That is unfair to the rest of the community. I do enjoy the homebrew, and the emulators though (which is also piracy unless you own a copy of the game). As for banning everyone that has jailbroken their PS3, I think that is a little over the top. Sony should find a way to detect players going online with "burned" or "back-up" games and ban them, because just having some homebrew apps isn't hurting anyone, but going online with burned games hurts that community. It shouldn't be that hard to detect who is running games of their HDD, or of a burned BR disc because they have signatures encoded to tell the device what kind of media it is. I am sure sony can read that when the game goes online. I think this should turn out like the iphone, jailbreaking should be legit, however pirating should still get you banned so the choice should fall on the end-user to make that decision (to get banned or to not get banned). Sony will have to come up with some new lines of defense in future updates however to prevent people from getting online with modified (burned, back up'ed) games. I am all for homebrew, if your going to be a pirate though, stay offline!

      To be honest pirating ps3 games is really a waste of bandwidth. Who in their right mind is going to download 48GB game or a 25GB one? I mean their ISP would surely catch on and then question why so much download in 1 day since most ISP's only allow 60GB - 120GB a month. Not to mention the space you need on your PS3. Not everyone upgrades their hard drives to hold 20 games on them.

      To be honest the amount of people that hack their Ps3's are probably like 100,000 out of the 300 million systems sold. So I don't think Sony has anything to worry about on this one.

      Reading the sony developers' posts to the various mailinglists after april '10, Sonys reasoning of removing OtherOS from slims (way before geohot's crack, btw), and the arrogant way Sony patched that "vulnerability" - it shouldn't be at all unclear why they pulled the plug. Money. Mainaining OtherOS cost money. And Sony didn't find it worthwile. But to do it the way they did - even employees of Sony that I know personally don't want to talk about it for their embarrasment.

      And if you don't believe me, consider this: Sony didn't actually remove OtherOs - they removed EITHER OtherOs or PSN/new games. So, please to explain to me, how securing all the PS3s of non-interested end-users helps, when the PS3s of the hackers retain the gaping "security vulnerability" that was OtherOS.

      No, sir, we didn't lose Linux because of this lowlife. But because of lowlife like you, we might lose great battles in freedom at the electronic frontier. Please stop for a moment, and reconsider your stance. Thanks.

      emulators are nothing more than backup managers...and its not like your backing up your super nentindo games anyway...im doubting all these people have the technology to rip any cartridge game, so where you going to get it? download it? making you no better than ps3 "pirates". and i have yet to see any homebrew aside backup managers, emulators, and the new erase your blah blah blah so you don't get caught using back up managers and emulators....

      I've gone through 400GB in a month, easy. That month was only the biggest, I don't think I ever had a month under the 250GB "cap" they gave us. Maybe I was lucky, but your ISP's suck.
