  • Forensic Analysis Of Geohot's Hard Drives In Dispute

    Earlier this month, we reported that the court hearing Sony's case versus Geohot, had ordered the New Jersey based hacker to turn over all of his hard drives to a third party. According to Geohot's attorney, the court did not allow Sony or the third party to make copies of the hard drives, but only store them. The company holding them, known as TIG, is now recommending to Sony that backups of Geohot's hard drives should be allowed by the court. Sony has submitted that request to the court and also is demanding that Geohot turns over any keys or passwords used in decrypting the drives.
    Attachment 936

    The original court order only called for the drive(s) to be delivered to a third party "for the purpose of isolating, segregating and/or removing the information on those devices related to Defendant Hotz's circumvention of the TPMs in the PS3 system."

    Now the company doing the analysis wants to create TWO FULL IMAGES of the drive(s), in both decrypted and encrypted form!!! According to Geohot's attorneys, "SCEA is not entitled to inspect the impounded drives under the impoundment order, nor is it allowed to create and preserve additional copies of the impounded drives, but this is precisely what it seeks to do."
    For the foregoing reasons, SCEA requests that the Court order that Mr. Hotz comply with TIG‟s recommended impoundment protocols and that those protocols be supplemented to ensure that preservation requirements are met as follows:

    (1) TIG create and preserve two forensically sound images (e.g., bit stream images) of each impounded storage device in its encrypted form: One to be maintained by TIG in a secure vault for preservation purposes and the second to be used for decryption and/or any other necessary analysis by TIG;

    (2) TIG create and preserve two forensically sound images (e.g., bit stream images) of each impounded storage device in its un-encrypted form. One to be maintained by TIG in a secure vault for preservation
    purposes and the second to be used for TIG‟s necessary analysis; and

    (3) TIG maintain and preserve all of the forensically created images for the duration of the lawsuit.

    SCEA further requests that the Court order Mr. Hotz to: (a) provide TIG with the tools and keys necessary to decrypt the impounded storage devices and the keys and passwords necessary to decrypt or unlock any protected files contained on the impounded storage devices;

    (b) identify for TIG all virtual machines or hard disks stored or at any time run on the impounded storage devices.3 Furthermore, to verify compliance with the impoundment order, SCEA requests that the Court order Mr. Hotz to provide a declaration setting forth: (i) verification that all storage devices on which any circumvention devices or any information relating to Mr. Hotz‟s circumvention of the technological protection measures in the PS3 System are stored have been delivered to TIG; (ii) why the storage device used by Mr. Hotz in the January 7, 2011 YouTube video entitled “Jailbroken PS3 3.55 with Homebrew” was not delivered to TIG for impoundment; and (iii) the identity of any remote storage of the circumvention devices or any information relating to Mr. Hotz‟s circumvention of the technological protection measures in the PS3 System.4 Finally, SCEA seeks fees and costs in relation to this motion.

      my guess is that the 3rd party already looked in the hard drive and found something useful to sony

      Are the $ony lawyers idiots or what? If they want something then they have to ask the court with very clear and specific terms. The manner that they are making their request sound like they are asking the court to order Geohot to give them a piece of paper.

      Since its electronic evidence, the process is very different. The Court should be telling the idiotic $ony lawyers to decide clearly upfront what they want instead of coming back and forth wasting the court and everyone's time. Of course going back and forth will do the lawyers good since they can charge their client more $$.

      If i were sony I would go for a settlement, Have geo help patchup and design new hardware, and enable other os to all consoles including slims. I know this has probably been said 1,000,000 times but thats what I think would be best for everyone. that seems like that would discourage jailbreaking which is what they want if they brought back linux with access to ALL of the ps3.

      It is indeed waste of everybody's time & money either way. Lawyers benefits most in prolonged procedures.

      It could have been better on R&D for more lucrative devices or on better games & softwares...

      lol yeah exactly, I found this line especially entertaining:

      "why the storage device used by Mr. Hotz in the January 7, 2011 YouTube video entitled “Jailbroken PS3 3.55 with Homebrew” was not delivered to TIG for impoundment"

      It probably was delivered just he probably deleted the vids.

      Just for giggles. "Als we all know this will NEVER happen, but if a settlement were to be made and they released a OFW that brought back OtherOS (and you know sony) losing the back-up mangers, would you do it? I asked myself that question, and as mad as I was to lose the OtherOS I much rather have my two 2TB and Multiman, sorry.

      What do you think he is ****ing stupid he had plenty of time to do whatever he wanted to before they ever turned over any equipment, this was not a police investigation like with graf where they broke in unannounced and took everything.

      ****ing idiot sony just wasting millions with dumb**** attorneys that are just milking them that dragging this out.

      Hotz needs better lawyers. TIG "recomandation" to Sony means they looked at the drives, when they aren't supposed to. Same with passwords and the "absence of the youtube video", they have looked at and are looking at those drives. The court can mandate TIG to decrypt the information under Sony's request, but to look at it and investigate themselves overextend their power and could make any evidence on those disks unreceivable, it has been tempered with, even if nothing is changed. Furthermore, if TIG speaks with Sony outside of court procedures, the court is deemed not impartial. Someone on Hotz's side isn't doing his job.

      In Soviet Britain if you forget your passwords, you are guilty of an offence punishable by up to two years in one of her majesties finest hotels!

      Welcome to RIPA.

      Also, if under RIPA you are being monitored, discover this and tell anyone, that in itself is also an offence punishable by up to five years of imprisonment...

      Ah, what fun, when we're not being watched by cameras everywhere we're being watched in other ways, heh

      your all missing the point about the you tube video,

      sony want the usb stick geo use in the video. not the hdd the video is on.

      the court ordered the drives be handed over so any data relating to the jailbreak could be found and removed.

      it sounds like geo has implemented some form of hdd encryption, in order to preserve the forensic intergrity of the original drive (must be done to prove what they found was on the original, ie the process can be repeated again and again by many different companys to verify) they have to make a copy, for them to play with, so they make 2 one is a master copy the other is a working copy. then when they discover they fked the workign copy they make another from the master, without risking reading the drive again.

      this is exactly what is happening with graf's hdds, and is standard procedure in any police/fed investigation.
      TIG are following their protocols for data retrevial and evidence preservation. nowhere in those docs does it say sony gets the backups? one in the vault and one to work with?

      somehow i cant see the 2 hdd being the ones sony wanted, they are more likley dumb drives that geo made a backup of all the jailbreak suff too just to comply with the order.

      2 hdd sounds like putting all your eggs in one basket to me.

      Sony should say to their public: "We don't recall for whatever shit games we gonna pop with on the PS4. But we need to send a message for future potential hacking for other systems and ours on next gen. We won't have games to compete with competition but stay tuned for PS5."

      Seriously, Sega were much more intelligent than that. When Utopia hacked their GD-ROM format protection for the Dreamcast they did not sued Utopia. They paid Utopia to help them secure the Dreamcast and they came out later with dreamcast models that had CD audio playback disabled to block the utopia boot loader. I wish it was Sony that went out of console business instead of Sega.
