Sony Issues Official Statement - Ban Wave Coming

This seems a bit backwards to us, but after countless legal proceedings, DMCA notices, and firmware updates, Sony has finally issued an official statement on PS3 hacking. The statement basically tells consumers to stop playing unauthorized and pirated software or their access to the PSN will be revoked. This seems to be in direct response to the recent methods of re-enabling the PSN on 3.55 firmware. It appears that Sony may be planning a ban wave, since their efforts to secure the PSN have failed.

Today, Sony Computer Entertainment released the following statement:

Notice: Unauthorized circumvention devices for the PlayStation 3 system have been recently released by hackers. These devices permit the use of unauthorized or pirated software. Use of such devices or software violates the terms of the “System Software License Agreement for the PlayStation 3 System” and the “Terms of Services and User Agreement” for the PlayStation Network/Qriocity and its Community Code of Conduct provisions. Violation of the System Software Licence Agreement for the PlayStation 3 System invalidates the consumer guarantee for that system. In addition, copying or playing pirated software is a violation of International Copyright Laws. Consumers using circumvention devices or running unauthorized or pirated software will have access to the PlayStation Network and access to Qriocity services through PlayStation 3 system terminated permanently.

To avoid this, consumers must immediately cease use and remove all circumvention devices and delete all unauthorized or pirated software from their PlayStation 3 systems.

What this means to you
Circumvention devices and game piracy damage our industry and can potentially injure the online experience for you, our loyal PlayStation customers, via hacks and cheats.

Many PlayStation.Blog readers have asked how we intend to deal with these incidents that they have been reading about in the gaming press, and this is our initial response.

By identifying PlayStation 3 systems that breach our guidelines and terminating their ability to connect to PlayStation Network, we are protecting our business and preserving the honest gameplay experiences that you expect and deserve.
Rest assured, this message does not apply to the overwhelming majority of our users who enjoy the world of entertainment PlayStation 3 has to offer without breaching the guidelines detailed above, and we urge you to continue doing so without fear.

I for one wont be crying here. I knew this day would come that Ban's would start to happen. Anyone with half a brain cell would have guessed this would have been Sony's Reaction. To be honest this should have happened on day 1 when the USB Hack was announced!

You know, I avoided you for awhile. Thinking that you're some troll that will be banned soon, but now I realize that this site needs you. I mean, think about it. There won't be a super hero without a super villain. There won't be democrats without republicans and vice versa.

Anyways, still your statement about being online is wrong in my opinion. PSN is just a portal to get you online to play with others. Well, that's what we all have a PC for. And as far as PSN games go, there's no point for that either. If there's capabilities to download games and put them on backup managers, then there's no point in using PSN for that.

WHAT WE KNOW:

1. It is the PS3 MACHINE that gets flagged – NOT JUST USER ACCOUNTS. Too many comments proving this have been logged.

2. It is NOTHING TO DO WITH KILLZONE 3 – many people are receiving these mails who have never let the game anywhere near their PS3. However, whether it’s for with playing any games before release date, we’re not sure. Maybe you’ve had Deadspace 2, or MVC3?

3. It is NOT just a ‘blanket’ $ony email to everybody. They know who they’re sending it to. There are many confirmed reports from ‘100% legit’ 3.56 people who have not received any email. They’re safe – go figure.

4. It is NOT THE FAULT OF THE ‘F*CKPSN’ feature, or the CA24 (Although it probably hasn’t helped) – but too many people are getting the email who never got round to doing it. Me and a few mates were just about to try it when this kicked off, and we have received the 3mail of doom.

5. HOW MANY TIMES YOU HAVE LOGGED ON TO PSN. Once? Twice? Three times a lady? It doesn’t matter. Even if you logged on for 8 seconds for sh!ts and giggles, that seems to be enough. You’ll get flagged if you’re on the internet in any way whatsoever with your PS3 – logged on or not.

6. BOTH CFWs & DONGLES CAN GET YOU FLAGGED. I believe there are too many comments stating this to be bullsh!t.

7. IT HAS NOTHING TO DO WITH ANY WEBSITE YOU ARE A MEMBER OF. Take off your tinfoil hats, people. I have many friends & relatives who have received the 3Mod, yet have NEVER joined or commented on a PS3-hacking related website.
8. PS3NINJA DOES NOT HELP. Many reports coming in from people who use it religiously and have still gotten busted.

9. (NEW) DELETING HISTORY DIDN'T HELP. It was a good idea, but it now appears it raised more issues than it solved (Please see perspex' Comments below).

WHAT WE DON’T KNOW (but would like to find out):

1. EXACTLY HOW MUCH $ONY KNOWS before they’ve issued the 3Mod – I haven’t found a single piece of conclusive proof that it is anything other than logging on to PSN with a FW .56. Is it the Mac Address? IP? Processor serial? Who knows? (Well, $ony do obv)

2. WHAT THEY’RE GOING TO DO NEXT. Duh, but are these temp bans?, permanent bans?, or threats that they cannot actually carry out? Time will tell.

3. If it was down to the initial ‘DNS trick’. Now this could be proven / disproven soon enough, but I haven’t read anything conclusively that states that people who never used the initial DNS trick

4. WHY SOME PEOPLE SEEM TO BE GETTING AWAY WITH IT. Bullsh!t? luck? Ignorance? But there are many posts from people saying they’re still on PSN, have not received and email, and are playing on a ‘hacked to the @sshole’ system. More info is required.

5. WHETHER IT CAN BE FIXED. Because we’re still speculating as to how they’ve rumbled us, no-one yet knows how to fix it. Was it Linux? Homebrew? Backup Managers? However, If the XBOX can be unbanned, it can’t be beyond the realms of the imagination of scene people far cleverer than me to find a workaround.

Looks like we’d all better wait until it dies down and more info is out there. In the meantime, I wonder if a CFW 3.56 would fix this? And WHERE THE F*CK IS IT?

I think something that we don't know triggers the flag because I have 1 alternative account that I used online and it did not get the e-mail. The list of things that I did WHILE online was: Play MW2 with Gun Game, Black Box FTP, SNES and a few others. Question is: What causes the accounts to be flagged and e-mailed. Seems odd that I did not take any precaution with using that account that others did; yet it didn't get flagged. Also, I was on Kmeaw's firmware and it was when 3.55 was the current version. Maybe random scans? or doing something certain triggers a scan? I don't know but it might be something someone could look into. Oh, both my alternative and main accounts exist on the same ps3 and only my main account got the email.

UPDATE: I couldn't resist logging in to PSN last night. I was on for about 3 hours, Still no email/ban.
I played it safe tho;
I wiped my history first, then just played my games off the disc (making sure i didn't load any homebrew apps after i wiped my history).
I'd also like to note that I'm not using CA24 anymore. It's obvious that SONY is monitoring these forums. I'd rather not say what method im using, but if you follow the right devs, then you know what i'm referring to.
Anyhow, after 3hours of PSN, i enabled my DD-WRT rule (Deny internet Access to PS3), and back to my homebrew apps i go.

IN SHORT: Don't be on PSN while RUNNING Homebrew apps, and you might be OK.
I wiped my history, DID NOT run any Homebrew apps after, played LEGIT game off of LEGIT DISCs (2 different games), STILL NO BAN.

I will try PSN again tonight with the same methods and hope for the best.

I think it's bullshit that sony is doing this, but I can understand why. I believe that .. if you own a PS3 .. you have the right to do whatever you want with it.. hell.. if you wanna put wheels on it and drive it up and down the road.. do it!! I like the CFW and Homebrew, How is haveing CFW and Homebrew piracy?.. or backing up games.. I own 4 PS3's in my house and I'm not going to buy 4 of the same games on each system.

Agreed, but if you want to go online PSN, you gotta play by there rules, and that makes total sense to me. It's MY CONSOLE, it's THEIR NETWORK. Choose wisely...

Oh yea.. I agree.. I changed it back to 3.56 and did it safely.. first thing I did.. Formated it quickly and then the 9 hour formatt.. default everything and then installed firmware 3.55 .. it will delete the install package file.. then update it to 3.56... haven't had any problems.. I will let you all know, if anything comes up!

OK so you know how Sony and every big company don't give a sh.it about Latin America right?

Well i was looking at the different Sony blogs around the world and the only region that did not get the Official statement was Latin America (I live in Mexico).

i don't know if that means we'll be safe but i am online right now and i am on CFW and Multiman. No email for me or my friends so far.

what about if you do not have a psn account registred to that ps3, but you are still connected to internet to update games or just surf on the web? (on 3.41ofw with jailbreak.)

but i have another ps3 on ofw 3.56 connected to the psn thru same internet connection.
is it possible to recibe a ip ban or something like that?
or everything will be ok with my config?

Ooh Not sure about that one.
Does it ask you to update when you turn on your 341 ps3? If so, I wouldn't even risk being online if not needed. Just use the PS3GameUpdater and install the pkg updates instead...

got email. currently online with legit copy of black ops.

worse case..i get banned.. if i feel like playing ill buy a ps3 for cheap.
you figure..update to ofw 3.56...buy legit games for damn near 60 a piece. with at least 4 games purchased i ncould buy a used/refurbished ps3 for like 200 if not less.
