  • Geohot Ordered to Hand Over Hard Drives to Sony

    The legal battle between Sony and George Hotz (geohot), took a surprising turn today. U.S. District Judge Susan Illston ruled from the bench, ordering geohot to hand over his computer hard drives to Sony. The electronics maker will be allowed to examine the drives with a fine tooth comb and retrieve information "that relates to the hacking of the PlayStation".

    Sony to Inspect PlayStation Hacker’s Hard Drive

    SAN FRANCISCO — PlayStation 3 jailbreaker George Hotz must allow console-maker Sony to comb through his computer’s hard drive and retrieve information “that relates to the hacking of the PlayStation,” a federal judge ruled Thursday.

    U.S. District Judge Susan Illston’s ruled from the bench in Sony’s ongoing legal action against the New Jersey hacker, who goes by GeoHot. The lawsuit is in connection to the 21-year-old being the first to fully hack the 4-year-old console, a jailbreak allowing it to play pirated and home-brewed games.

    Hotz posted the code on his website last month, and put a how-to video on YouTube. That landed him in court here on Digital Millennium Copyright Act civil allegations. Among other things, Sony accuses him of trafficking in devices that circumvent controls meant to protect copyrighted works.

    In the Thursday hearing, Hotz’ attorney, Stewart Kellar, objected to the judge’s bench order, saying Sony would be able to “observe” the contents of all his client’s files.

    “That’s the breaks,” Illston said.

    Hotz has already removed the YouTube video and the code from his website to comport with the judge’s earlier orders.

    The judge had originally ruled weeks ago that Hotz must surrender all of his computer gear to Sony. But Kellar asked for reconsideration, and a hearing was hastily called Thursday

    Illston informed Kellar that it was routine for the entire contents of computers to be searched in a bid to isolate what is being sought, as in child ****ography prosecutions.

    “Your honor, we’re certainly not dealing with child ****ography in this issue,” Kellar replied.

    Moments later, the judge responded:

    “Here, I find probable cause that your client has got these things on his computer,” she said. “It’s a problem when more than one thing is kept on the computer. I’ll make sure the order is and will be that Sony is only entitled to isolate … the information on the computer that relates to the hacking of the PlayStation.”

    The DMCA makes it either a civil or criminal offense to traffic in wares meant to circumvent devices protecting copyrighted works. Performing a similar hack on a mobile phone is lawful.

    Sony’s attorney, James Gilliland, was quick to point out to Illston that the mobile phone is not at issue here. “The conduct Mr. Hotz has engaged in is still covered by the DMCA,” he said.

    The judge also backed off on an order that Hotz “retrieve” the code from anybody who he may have forwarded it to.

    “It’s information. It can’t be retrieved. It’s just not practical,” Illston said. “What would they do, Xerox it and mail it back? ”

    Illston said she changed her mind because she was not clearly aware of the details in her earlier order.

    “This kind of got away from me and I apologize for that,” she said from the bench.

    The judge ordered Sony and Kellar to confer with each other on the parameters of where and when Hotz would allow Sony to sift through his computer. She also ordered him not to delete or modify any files connected to the jailbreak.

    Meanwhile, Sony is threatening to sue [.pdf] anybody posting the code, even though Sony accidentally tweeted it earlier this week.

    Sony’s attorney, Gilliland, said the Japanese console maker has been sending out an undisclosed number of DMCA “takedown” notices to websites demanding the code’s removal.

    Sony is also asking Judge Illston to order Google to surrender the IP addresses [.pdf] and other identifying information of those who have viewed or commented about the jailbreak video on Hotz’ private YouTube page. The game maker is also demanding that Twitter provide the identities of a host of hackers who first unveiled a limited version of the hack in December.

    A hearing on that is scheduled next month. Sony is seeking unspecified damages.

      theres software to wipe your whole drive then write random data to it so you cant recieve deleted data see windows and other oses dont delete the data they mark it as deleted until its writen over

      GeoHot harddrive, I bet that drive also content Apple Iphone Jailbreak code. Legal problem in the US is a nightmare and time consuming. Good luck man.

      Thats probably true, but one thing you have to know is when you're rich in the US, you dont wants to get into too much legal problems. Like I say, the court system, lawyers and people who sue you will milk you dry. Sad, but true.

      The main reason Sony would be going about it this way is because developers would pay a premium to Sony to cover copy protection makes developing games quicker and in some cases probably cheaper (many protection systems have very hefty licensing fee's)
      now Sony would have a legal obligation to the developers to make sure the system is secure from piracy

      the other reason is for online gaming hacks if the system is secure you dont need to develop Anti cheat within the game itself.. (again making it quicker and cheaper to develop)
      in some cases they would have never bought the ps3 to begin with

      erm..how is he supp to do dat..as far as i know...court officials will accompany geohot to his home to retrieve his HDD, if they told him "ok, give us ur HDD..u have till tmrrw", den any tom,dick n harry and just delete all evidence.

      OK guys, this is how the US legal system works. When the Judge order GeoHot to hand over the Harddrive. That harddrive became an evidence. Court official dont have to accompany him to retrieve the HD but most case they will. The best thing GeoHot can do is just hand it over and let them search whatever is in there. If GeoHot try to deletes or wipes his HD after the Judge order, he can be charge with tempering with evidence and that's became a federal felony charge. And that can put him in jail in a heartbeat.

      I hope this will turn around for GeoHot but i dont see it happening hes in the legal system now and thats about as ****ed up as the comments turkish makes and poderpelon make. So either way it goes sonys not really achieving anything what people do in private is there business so in the next couple of months or maybe a bit longer we will see a 3.xx cfw and the BM's will still have updates and reguardless all the stuff that sony didnt want to happen will happen like failoverflow said,"the whole system is compromised". so the only reason there doing this to geohot is to make an example out of him. Next time just be anonymous.

      depends how he wipes the hard drive.. i would wipe the hard drives and say *proove it* because they got no evidence.. they cannot guess whats on the hard drives.. or fill em up with ripped dvds tht he owns then they have no chance! lol

      I understand Sony's wish to keep pirates off their machine. Fair enough. Piracy severely damages the industry, and there are plenty of families reliant on their jobs in the games/hardware/retail industry.

      What Sony need to do, instead of frothing at the mouth and going rabid, is to sit down with the homebrew developers, and work WITH them to allow homebrew (eg Linux and emulators etc) on the PS3, but to work out a way to detect pirated games. I`m not sure if that's possible, but it's worth investigating. If the Sony and Homebrew devs got together, it would be a much more secure, and better, system.
      Let me explain,
      Earlier this week the judge made the order for Geohot to surrender his HDs. However Geohots lawyer argued that they must have a hearing before any such order can be made, thus they had a hearing today and decided that the order will go through.

      This part is particularly outrageous. To surrender end user ips of people people that read a line of meaningless code (to them) and view a youtube video??? WTF is $ony trying to prove? That they're lawyers can bypass more human rights violations than any other company??? What a violation of privacy. Over a DMCA that should be countered with the "fair use" argument, and a EULA that shouldn't even be looked at in the courts. I've said it before and I'll say it again... $ony has to be paying these judges off. Every time something they want gets denied, another judge approves it. Ridiculous! If $ony wants to continue playing this suing game, we should sue back. Someone has to know of a good class action lawyer with the ability to get the job done. Both free PSN and OtherOS were advertised on the packaging of the PS3 at one time. $ony then forced users to choose between the two. That's illegal pretty much everywhere. Why are they the only ones allowed to break the rules? A EULA? They were thrown out of court when it came to music cds. The reason: you were forced to agree to them AFTER purchasing the product, wish was advertised differently.

      I'm gonna support geohot,
      I'll search for or follow to the keys,
      I'll post them in the 'off topic'/'rant'/... sections
      of other forums that i'm regestered to,
      i'll upload them to a few 'google.sites' pages that
      i edit/create,
      I'll copy links of every site that this gets uploaded to
      and copy them after the copies of the keys so people
      can see every copy i make linked up with these links,
      All needs to be done is others following this approach.
      What's sony going to do? Sue EVERYONE??

      To some 'facts' I know of (may not be accurate however close)...



      Mechanical Hard drives:

      Due to the nature of magnetism, electrons, quantum physics, and other related effects,
      a magnetic platter cannot easily just be wiped as the electrons are still partially aligned.

      This variation in alignments can give away what was present there before (to extent),
      and can retain that information for up to a years of use (not sure how long actually).

      This alignment degrades over time as the 'data bits' get inverted due to re-writes.

      If geo wanted an easy to erase drive,
      He would of obtained an 'IBM Deskstar' (also known as Deathstar).



      Solid Silicone Hard Drives (SSD):

      These are more secure when erased, UNLESS OF COURSE...
      The EXACT same data was re-written to the EXACT same address 1/2Million times.

      As they would be able to test for degrading gates/bits and the data is easier to
      reconstruct than that of the mechanical types of hard drives.

      cannot guarantee accuracy, Google Is Your Friend (till that becomes Illegal)
