  • Sony Issues DMCA Notices to Gitorious - Website Says Enough

    It seems Sony isn't done taking on PS3 scene devs. Their latest legal demonstration, comes in the form of taking on Norwegian code repository site, Gitorious. Sony is demanding PS3 developers work be taken down from the site. However, Gitorious doesn't seem to be complying as easily as previous websites have.

    We reported last week, that Sony had issued Digital Millenium Copyright Act (DMCA) notices to several websites, which were hosting PS3 scene developer's projects. The main site issued DMCA notices was gitHub, a site commonly used by programmers, to host code for various programming projects. Most PS3 scene developers work was removed from gitHub, so they moved their projects to a competing site called Gitorious.

    Well, it seems Sony also took notice, spotting that devs were moving their projects over to Gitorious. Sony recently issued Gitorious DMCA notices, stating to take down these dev's projects. However, here's the twist, Gitorious isn't blindly complying, unlike other sites which have. Gitorious temporarily removed the initial content in question, but notified Sony that they would not comply with further requests, unless issued Norwegian court orders.

    It will be interesting to see how this pans out between Sony and Gitorious. Sony may choose not to pursue the site any further, instead focusing on other sites, ones which may give in easier.

    An update on the Sony DMCA issue

    We have just sent an email to Sony’s legal attournes in reply to their DMCA takedown notice sent to us yesterday:
    Re: Demand for removal of claimed copyright infringing content from Gitorious.org


    This is in reply to your notification of United States Copyright Law Violations at Listed URLs, dated February 1st 2011. As we confirmed via email yesterday, the content was taken down from gitorious.org yesterday at 3.18PM CET.


    Your claim made reference to US law, which is not applicable in Norway. When removing the content from our server placed in Norway, we did so to avoid being in violation with Norwegian law, to the degree that Norwegian and US copyright law is compatible.


    However, it is unreasonable, and in conflict with basic legal principles, to assume someone as guilty until proven innocent. Allowing any third party to demand the removal of content on gitorious.org based on unproven claims of copyright infringement would assume any gitorious.org user would need to prove his innoncence under Norwegian law. This is unacceptable to us.


    Our Infringement Notice Policy (http://en.gitorious.org/infringement_policy/) requires any Infringement Notice to include:
    - An identification of the intellectual property right claimed to have been infringed


    Since your letter of yesterday contained no reference to Norwegian law we kindly ask that you prove that the content is in fact in violation of Norwegian law. We will not act on further Infringement Notices related to this content until SCEA provides a Norwegian court order that deems the content in question as being in violation of Norwegian law.
    Gitorious wants to make it absolutely clear that we have no agenda relating to the repositories in question. Our initial response to this notice was motivated by the fact that Gitorious could possibly be held accountable for not responding should this content be deemed illegal (with reference to “Ehandelsloven” §18). We object deeply to any violation of the basic legal principle of being innocent until proven guilty. This is why we have passed the ball back to Sony.


    We hope you understand that it is not in Gitorious’, or the majority of its users’, best interest to pick this fight. We don’t have the resources nor necessary domain knowledge to assess the legality of all of our projects, which is why we have terms of service that state that users carry this responsibility.

      Sony should be found guilty of this, 3.56 having a rootkit in it spying on people PS3 and this is legal yet they wanna sue people for install and or creating homebrew

      i swear go check the site, a moderator by the name 'kilak' (or some shit like that) made a thread that cfw 3.55 users could install a .PKG file that would allow them to play BLACK OPS online after treyarch had CONSOLE BANNED them . . . . . so he LINKED us to the download file and said at the end of the thread UNCONFIRMED if this works . . . .

      basicly that shit site removes (and that stupid mod) ANY thread with 'unconfirmed' written on it , then the dumb ass mod write 'got this from ANOTHER site but i cannot tell you as it would be advertising . . . .

      what kind of bullshit is that ? fking idiots, i hope sony would ban there site the gaylords

      I can fully vouch for this site. I watched it grow from a tiny seed to a big Oak tree in the short space of a few months. This site has come a long way and the best thing about it is the info is up-to-date, the community is nicely mixed and it looks nice. I enjoy contributing here, and I love the banta between some of the dumb asses also. Lol.

      PSGROOVE FOR LIFE! No one can deny it's not a great site. I mean people have registered just to make a single comment and then found them selves revisiting on a regular basis. It's addictive! Just admit you’re a fiend! Now go get your daily dose of PSGROOVE!

      Back to topic..........I'm glad Gitorious are taking up that attititude. They are saying to Sony "You created this mess, so fix it your f&%@ing self and stop pestering us to clean up you S&@t!"

      Also on top of that if a small company was in a similar predicament do you think Sony would lend a helping hand?

      Hmmm... the XBOX has been Jtag'd for HOW long now?? And I don't see Microsoft going after the dev's who made the exploit available. They just ban the users who want to go online and cheat.

      And unfortunately it'll die within a year or so and you'll be back to PS3 because there's no real other option out right now.

      As long as "probable cause" has been established............you are screwed no matter what the outcome.
      I would like more info (preferably some examples) on this compensation that you speak of. I have NEVER heard of anybody being "compensated" for wrongful incarceration.

      Have had my 360 for several years with only 1 issue.
      X clamp mod fixed it perfectly.
      The thing gets bounced around a 1 ton van quite a bit.
      I just happen to have had real good luck maybe.
      I truly enjoy all the systems I have.

      While I love to play GT5, infamous and a few others on the PS3.............
      I find it rather hard to play Halo 3, ODST or Reach (just to name a few) on the PS3.

      Plenty of games out in the world that are platform specific.





      Not real sure whether Gitorious has done a good thing or are just asking for trouble.
      I will have to say that they did the legally correct thing.
      Will now have to wait and see what Sony's retort is.

      Beat me to it. I've read all the comments hailing Gitorious as some sort of heroes but at the end of the day, they've sold out and caved in like all the others. Only difference is that they wrote back to say that they weren't happy about doing it.

      Actually read the articles before blindly agreeing with them people...... ;-)
